I would love some feedback on my approach:
I am starting initial LEED design for a typical mixed use project. It is developer driven 1st flr retail with 4 flrs of condos above. Because the developer has control of over 50% of the building I belive it has to go LEED NC.
I don't have any retail tenants now, and probably will have no design control of their spaces. I want to exclude thier TI from the rest of the project. Will USGBC hit me for not including this portion in the submittals? I see very little latiitude for NC projects that have small CI areas.
Any input or experience would be great!

Since your project is mix use and you have residential units, it should be LEED NC. LEED CS would not be applicable for some of the reasons you stated. Mainly because of the residential units which you are going to fit out.
As far as the tenant spaces are concerned, you would still have control over the HVAC components and the main controls. So you submit based on what you do know. The developer creates the CC&Rs, so it is up to them to spell out LEED criteria to the tenants to avoid having one tenant who messes up any of your credits.
It might be a good idea to check the CIRs to see if anyone has asked the same question. Mix use LEED projects have been done quite a number of times. _________________ Gerard Lee Architects
